Tahmoor miners locked out again as Xstrata plays it tough

WORKERS at the Tahmoor Colliery have been locked out of their workplace until September 7 as the dispute between them and mine owners Xstrata Coal escalates.

The lock-out is the latest in the 21-month wrangle to get a new enterprise agreement for the Tahmoor workers.

It is the second time this year that the company has locked out workers and is retaliation against the Construction, Forestry, Mining and Energy Union for its continuing industrial action at the colliery.

Xstrata Coal communications manager James Rickards said the company was well within its rights to respond to industrial action.

``To date the union have taken 3000 hours of industrial action,'' Mr Rickards said.

``Xstrata Coal have taken only 96 hours in responsive action; the last time was in February. The union have had continuous industrial action since June 4.''

Mr Rickards said Xstrata wanted to send a message to the miners that industrial action was not a legitimate negotiating technique.

``This mine needs to be profitable,'' Mr Rickards said.

``And it needs to be viable.''

CFMEU district vice-president Bob Timbs said the new lock-out was particularly disappointing, because less aggressive options were available to Xstrata Coal.

``Xstrata management offered a pay rise, but as we've said time and time again there are far more important things than pay,'' Mr Timbs said.

``Tahmoor mine workers simply want some security that they will not be replaced by contractors and a guarantee that they won't be forced into working 12-hour shifts at the company's discretion. It's really not that much to ask.

``Now Xstrata is trying to grind us down by locking workers out of the colliery until September.''

Wasn't $250 million in 2 years enough for you Mr Rickards. The mine would be more than profitable now if Xstrata wasnt so pigheaded about destroying the union at Tahmoor Colliery. How much profit is enough?

Does Mr Rickards check his information before he comments or has he got to the stage were he just says what ever Sharron Pickles says to him. As stated above that CFMEU has taken 3000HRs industrial action this equates to 4 1/2 Months are you trying to imply that they have been on strike this entire time because fact is they havn't. I also see the percentage has increased but the actual money value hasn't since previous statements made to media. Fact is doesn't matter if you sack them before they see it, its not worth the paper its written on. When you talk operational profit as stated buy the company $250M was made clear profit from Tahmoor in first two years of operation the second being during GFC. And as for industrial action not being a legitimate tactic this was supported by Fair Work Australia after 16 months of failed negotiations, what options are there. My question to Mr Rickards is why won't Xstrata go to arbetration and let an independent umpire decide. This whole mess could have been sorted out months ago.

Dave, CFMEU district vice-president Mr Bob Timbs said there are more important things than pay, so arguing about profitability is really missing the point. It is a tragic reality that in the 21st Century, with high standards of living and working conditions compared to most of the rest of the world, that we still have a body of people who have long since expired their mandate to protect the working conditions of employees. If being down a mine is a problem for you as a Miner, then - respectfully - find another job. If you don't want the incredible pay being offered which is 100% above CPI, whilst being able to live locally to be with your families rather than sitting on the M5 car park for two hours a day, there is about 6% of the population who really wouldn't mind coming to the area to enjoy your jobs instead. It is a simple choice really. Action like this simply serves to remind everyone else just how selfish, vindictive and harmful the Union movement has become, with a sound, solid argument to see the power of the Unions dismantled for the good of our local and global economy. Fellas, it's time to be men again, shake hands of good faith with your employer and get back to work.

JP, if you read the article correctly, the Xstrata spokesman was the one quoting that the company may fail to make profit out of Tahmoor Colliery. I suggested that Xstrata already has made good profit from Tahmoor Colliery and the could be making a profit right now. Not once did I mention personal issues. So get your facts right before waffling on. We support full time employment for Australians. Seems you just support global profits for global companies at all costs. PS-How much are they paying you?

JP it is obvious that you have never worked in a coalmine, and if you have you would realise that production is king. Unions are my best chance of keeping safe in this industry. And for that I will always be grateful.
